Pennsylvania DUI

Driving under the influence (DUI) is a criminal offense that will go on your criminal record. A court will not expunge your record if you are convicted of a DUI in Pennsylvania. Moreover, any previous DUI charge within the past 10 years will influence the severity of your criminal charge. Besides your prior record, your blood alcohol content (BAC) influences the penalties you face:

• First tier: .08 to .099
• Second tier: .10 to .159
• Third tier: .16 and over
• DUI breath test refusal

In addition to the criminal penalties you will face if you are convicted of a DUI or refusal of breathalyzer, there also may be additional civil penalties imposed by PennDOT. If your case involves additional civil penalties imposed by PennDOT, such as an administrative license suspension, you may have to file a PennDOT appeal in addition to fighting the criminal conviction. We will advise you as to whether civil appeal is necessary, and we will represent you in both.

New Jersey DWI

Whether you are a resident of or a visitor to New Jersey, you need to take a driving while intoxicated (DWI) charge seriously. We will handle both the criminal and civil aspects of a New Jersey DWI charge. New Jersey basically has a two-tiered DWI system. Courts will impose different penalties on people depending on their BAC:

• First tier: .08 - .099
• Second tier: .10 or greater
• DUI breath test refusal

New Jersey courts have seriously restricted your ability to negotiate DWI and refusal cases. The New Jersey Motor Vehicle Commission (MVC) also imposes surcharges, in addition to penalties imposed by the court, for conviction of DWI of at least 3000 dollars.
